1. Acceptance

By downloading, installing, or using InterviewStats ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

InterviewStats is an AI-powered interview coaching application that captures audio during video interviews, transcribes that audio, and generates a feedback report using large language models. The Service is provided as desktop software (Windows, macOS, Linux) and a web application.

The desktop application offers two capture modes that you configure before each session:

• Microphone-only: Records only your own voice via your device microphone. Other participants on the call are not captured.
• System audio (Elite plan — desktop only): Records both your microphone and your device's system audio output, which may capture the voices of other call participants in addition to your own.

InterviewStats does not automatically notify other call participants that recording or capture is in progress. Whether and how you disclose recording to other participants is entirely your decision and your responsibility.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement.

4. Recording, consent & legal compliance

InterviewStats is a recording and analysis tool. Like any recording tool, whether its use is lawful in a given situation depends on how you use it, who else is on the call, and the laws that apply in your jurisdiction and the jurisdictions of all other call participants. You are solely and entirely responsible for ensuring your use of the Service complies with all applicable laws.

Recording-consent laws

Many jurisdictions have laws governing the recording of private conversations. These vary significantly:

• All-party consent jurisdictions (e.g. California, Florida, Illinois, and several other US states; some EU and Australian states) generally require that all participants in a conversation consent before it may be recorded.
• One-party consent jurisdictions (e.g. most US federal law under ECPA, UK under RIPA in certain circumstances, many other countries) permit recording where at least one participant — typically the person doing the recording — has consented.
• Cross-border calls may trigger the laws of multiple jurisdictions simultaneously. You are responsible for determining which laws apply to your specific situation.

Using system audio capture (which may record other participants' voices) is more likely to implicate all-party consent requirements than microphone-only capture. We strongly encourage you to understand the laws applicable to your use before enabling system audio capture.

Your disclosure choices

InterviewStats does not mandate any particular disclosure practice. You may choose to:

• Inform other participants that you are using a recording or coaching tool before or at the start of the call; or
• Use the Service without disclosing its use to other participants, where this is lawful in your jurisdiction.

This choice is yours alone. InterviewStats takes no position on which approach is appropriate for your circumstances, and we provide no legal advice on this question. If you are uncertain, consult a qualified legal professional in your jurisdiction before using the Service.

Prohibited uses

• You may not use the Service to record conversations in circumstances where you do not have the legal right to do so.
• You may not use recordings obtained through the Service to harass, blackmail, extort, or harm any person.
• You may not use the Service to record conversations in which you are not yourself a participant.

5. Your other responsibilities

• Account security: Keep your login credentials confidential. You are responsible for all activity under your account.
• Accurate information: Do not impersonate any person or provide false information when creating an account.
• Acceptable use: You may not use the Service to infringe third-party rights or for any unlawful purpose beyond what is addressed in Section 4.

6. Indemnification

You agree to indemnify, defend, and hold harmless InterviewStats, its officers, directors, employees, contractors, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• your use of the Service, including any recording you make using the Service;
• your failure to obtain any required consent from call participants before recording;
• your violation of any applicable recording-consent, wiretapping, eavesdropping, or privacy law;
• your breach of these Terms; or
• any claim by a third party that your use of the Service violated their rights.

This indemnification obligation survives termination of your account and these Terms.

7. Payments & refunds

• Pay-per-report ($9): Charged once per report. Non-refundable after the report has been generated and unlocked.
• Pro ($25/mo) and Elite ($35/mo): Billed monthly or annually via Stripe. You may cancel at any time; access continues until the end of the billing period. No partial refunds for unused time.
• Annual plans: Billed upfront. Refundable within 14 days of purchase if no reports have been generated under the plan.

8. Intellectual property

InterviewStats and its content are owned by us. Your interview transcripts and reports are yours — we do not claim ownership. You grant us a limited licence to process your data solely to provide the Service.

9. AI-generated content

Reports and feedback are generated by third-party AI models (OpenAI, Anthropic). AI output may contain errors, inaccuracies, or omissions. All feedback is for informational and coaching purposes only and does not constitute professional career, legal, or employment advice. We do not guarantee any specific outcome, including job offers or interview success.

10. Privacy & data

Audio is processed to generate your report and is not retained beyond what is necessary for that purpose. Transcripts and reports are stored securely and are accessible only to you. For full details, see our Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the maximum extent permitted by applicable law, InterviewStats's total liability to you for any claim arising from use of the Service is limited to the amount you paid us in the 30 days preceding the claim. We are not liable for indirect, incidental, special, exemplary, or consequential damages.

13. Termination

We may suspend or terminate your account for breach of these Terms. You may delete your account at any time from the Settings page or by contacting [email protected]. On termination, your right to use the Service ceases immediately.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.

15. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
